Critique of Americas justice system – Part 17

Are your judges fair? Is your justice system working? How do you know?

If you have accessed the system, either by exigency or by mandate, you realize that these are fair questions. Part of the problem is the lack of oversight. No one is keeping an eye on the system, ensuring fairness and impartiality.

Oh, you believe, as the system has told you that the oversight comes from the system itself. You believed that? Will you put the judges in charge of reviewing themselves? Undoubtedly this is the first time you’ve considered it like this and not in accordance with the official stance of checks and balances by arrangement.

The first sign that something is not working is in this fact: 95 98% of all complaints on judges, made to a review committee mandated by congress as an attempt at reforming an out-of-control system are dismissed out of hand. The Whistleblower Protection Law

It was not until 1986 when a law protecting whistleblowers is made. Congress added an anti-retaliation protection to the then existing False Claims Act.

A whistleblower is a person who tells on something he believes is an illegal act. The employees are the most commonly known whistleblower. They tell on their employers which they suspect is doing or committing an illegal act.

Under the Whistleblower Protection Law, the employee should not be discharged, denoted, suspended, threatened or harassed in any form that discriminates the terms and conditions of his employment because of the legal act done by the employee.

The employee may be of aid in many ways possible on the investigation, testimony and the likes. However there are some constraints under the whistleblower protection law.

Reporting illegal acts that are only within the company is a ground for exemption. But still there may be public policies that could protect the employee from retaliation

If it turns out that an employer didn’t actually break a law, the employee is still entitled to whistle blower protection from retaliation, if he reasonably believed that the employer committed an illegal act.

Differences between common law and civil law – Part 2

Countries which have a legal system based upon English law have a common law system (e.g. Australia, Canada). In the USA, federal law is a common law system. Common law is law which has evolved over time from custom. They are heavily reliant upon case law and, thus, judges have a major role in developing common law. This law relies heavily on precedent set in previous cases. Thus, on the one hand, common law provides consistency while, at the same time, it is law which can evolve to suit the society and time in which it operates.

Civil law is based upon statutory codes. The laws are established ones and the judges interpret them (as opposed to making them). Civil law will encompass both a civil and a criminal code. As civil law is based on these codes, the citizen can refer to civil law to determine the law.

Commentary: O.J. Simpson and American justice?

Most Americans probably don’t realize that O.J. Simpson could have walked out of the murder trial and whispered “I really did do it” to the prosecutor and there is nothing that the American Justice system could do about it. When the words “Not Guilty” came off the lips of the jury foreman, O.J. got away with the most horrendous crime of the century.

It was horrendous because at that very second, the American justice system, which has always been flawed but well disguised, was exposed for the faulty system it really is.

O.J. did in fact rub our noses in it, his book describes how he did it…er, that is, IF he did it. Can’t come right out and admit it or someone might sue him. They can wait in line right behind the Goldman and Brown families for their compensation.

And now O.J. is going to show us once again how flawed the system is, the new charges against him will work out the same way. All he has to do is finding a lawyer who isn’t afraid to misguide the jury by deluding them into thinking poor O.J. was framed again.

How governments collaborate with business and the media

The power structures that result when both government and media are controlled heavily by or influenced heavily by a few individuals are unique and frightening. Wherever you have an oligarchical structure, that is power rested in the hands of a few select individuals, you inevitably see a rise in both the decline of a free press and of course a rise in state oppression of the citizenry. A truly free press is paramount to a free state. This is not to say that the government should not work with (or indeed, collaborate) with the media; indeed the media should have complete and unfettered access to all workings of the government. This is elementary as the media in our modern age is truly the only ‘power contender’ to the government, who (thankfully, in this author’s opinion) have monopolized the use of force, and ultimately giving them self the final say. Perhaps, with the inclusion of the Bill of Rights and it’s neighboring Canadian equivalent the ‘Charter of Rights and Freedoms’, you can now argue a third competing power structure, that is the rights of the citizenry (not to be confused with the citizenry themselves who have Continue reading

With litigation on the rise in U.S. courts, it’s crucial for our lawyers to steer clear of tunnel vision. Complex times require a comprehensive view of society before judgment is passed. But where in the cacophony of information can attorneys reliably turn for such reference? “To literature,” claims novelist and educator Ona Russell, “to books which imaginatively represent the cultures in which they originate.”

Literature and the Law is a growing academic field that examines the linguistic and philosophical correspondences between these two important disciplines. Russell points out that this “hybrid disciplinemuch like a hybrid carcan produce a healthier system.” Just as a single pebble stands weakly against the elements, a legal argument informed only by legal discourse can suffer a similar fate. The conglomerate rock gains strength in cementing its sediments. Similarly, implementing the lessons of literature in the courtroom can strengthen an attorney’s chances of success.
